Terms and Conditions
Article 1. Membership
(1) Applicants must accept all the conditions, to become members. Member fee is free of charge, but members must be deposit J 100,000 before start buying from daily offer.
(2) To become a member, please fill up the form, we will notify new members of ID and PASSWORD number. Members are fully responsible for use and control of their ID and PASSWORD. Not allow to sell or make use of their ID and PASSWORD to any third party.
Article 2. Payment and shipment
(1) All payment shall be made in Japanese Yen. (US$ and EURO currency can also pay depend on negotiation.)
(2) The successful buyer must complete the payment by T/T remittance within 2 days from buying date. (Profoma invoice will send to buyer). If buyer is failed to settle the payment within 2 days, it will be automatically cancelled. Cancellation fees and all other necessary expenses and costs money will be deducted from the deposit money J100,000.
(3) TOMINAGA will ship the car by the earliest available vessel after receipt of full payment.
Article 3. Limitation of liability
(1) TOMINAGA shall not liable for temporary stopping of services. TOMINAGA will temporarily stop services without prior notice for urgent maintenance, power failure or any accidents or causes beyond TOMINAGA control.
(2) TOMINAGA shall not liable for any damages for loss.
Article 4. Arbitration
(1) All disputes shall be settled amicably through negotiations between the parties. if such negotiations should fail to yield an amicable settlement, it shall be finally settled by arbitration in Tokyo, Japan, in accordance with the Rules of the Japan Commercial Arbitration Association.
